Terms of Service

These Terms of Service constitute a legally binding agreement between EthioSIM ("we," "us," or "our") and you ("you" or "your"). By using EthioSIM services, you agree to comply with these Terms. Please read them carefully.

1. Acceptance of Terms

1.1 Agreement

By accessing or using EthioSIM's website, or eSIM services ("Services"), you accept and agree to these Terms of Service, our Privacy Policy, and any additional policies.

1.2 Eligibility

You confirm that:

  • You are legally capable of entering into binding agreements
  • You are authorised to act on behalf of any entity you represent
  • Your use of the Services complies with all applicable laws

1.3 Consent to Jurisdiction

These Terms are governed by the laws of Ethiopia and any disputes must be resolved in its courts.

2. Account Registration and Responsibilities

2.1 Account Creation

To access Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the security and confidentiality of your account credentials.

2.2 Account Activities

You are responsible for all activities associated with your account, including:

  • eSIM purchases and top-ups made by you or authorised users
  • Compliance with these Terms by all individuals or entities using your account
  • Any data usage or other actions taken through your account

2.3 Resale Prohibition

Reselling EthioSIM eSIM services is strictly prohibited unless explicitly authorised in writing by EthioSIM.

3. Services and Usage

3.1 Service Overview

EthioSIM provides prepaid eSIM (embedded SIM) plans for global, regional, and local data connectivity. Our Services allow you to purchase digital SIM cards that can be installed on compatible devices without a physical SIM card.

3.2 Device Compatibility

You are solely responsible for ensuring your device is eSIM-compatible and network-unlocked before purchasing any eSIM package. We provide a compatible devices list for reference, but final compatibility verification rests with you.

3.3 Licence

EthioSIM grants you a limited, non-transferable, revocable licence to use our Services solely for your personal or legitimate business purposes.

3.4 Data Plans

Prepayment:

All eSIM packages and top-ups must be prepaid. Unused data cannot be carried over or refunded unless explicitly stated.

Validity Period:

Each eSIM package has a specified validity period (e.g., 7 days, 15 days, 30 days). The validity period begins upon first connection to a supported network ("first-usage" policy) unless otherwise stated at the time of purchase.

Fair Usage Policy:

Unlimited data packages may be subject to a fair usage policy, where speeds may be reduced after a certain data threshold.

3.5 Prohibited Uses

You agree not to use our Services for:

  • Illegal activities or purposes
  • Network abuse, including excessive bandwidth consumption
  • Automated systems or bots that bypass our interfaces
  • Any activity that disrupts or interferes with our Services or other users

4. Privacy and Data Protection

4.1 Privacy Compliance

EthioSIM complies with applicable privacy laws.

4.2 Data Processing

  • EthioSIM processes your personal data as necessary to provide Services
  • We use third-party service providers to support our operations

4.3 Data Security

EthioSIM implements reasonable security measures to protect your data from unauthorized access, alteration, or loss. You are responsible for safeguarding your account access credentials.

5. Payments

5.1 Payments

  • All payments must be made in advance of receiving eSIM services
  • Payment must be verified before eSIM delivery

5.2 Order Process

  1. Select your eSIM package
  2. Select your payment method
  3. Complete payment to the provided account
  4. Enter your transaction reference number
  5. Upon verification, you receive eSIM with installation instructions

6. Suspension and Termination

6.1 Suspension of Services

EthioSIM may suspend your access to Services immediately if:

  • Payments are overdue or payment verification fails
  • Your account is used in violation of these Terms
  • We suspect fraudulent or unauthorised activity
  • Required by law or court order

6.2 Termination by EthioSIM

We may terminate your account and these Terms at our discretion, with or without notice, if:

  • You materially breach these Terms
  • You engage in conduct that harms our Services or other users

7. Force Majeure

EthioSIM is not liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to:

Natural disasters, earthquakes, floods, or fires
War, terrorism, civil unrest, or government actions
Internet outages, network failures, or cyber attacks
Labor disputes or strikes
Pandemics or public health emergencies
Technical failures of third-party telecommunications providers

8. General Provisions

8.1 Amendments

EthioSIM reserves the right to modify these Terms at any time. Continued use of our Services after changes become effective constitutes acceptance of the modified Terms.

8.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

8.3 Assignment

You may not assign or transfer these Terms or any of your rights or obligations hereunder without EthioSIM's prior written consent. EthioSIM may freely assign these Terms.

8.4 Independent Contractors

EthioSIM and you are independent parties. These Terms do not create any partnership, agency, joint venture, fiduciary, or employment relationship.
